Jaime Roriz Lawyers

Legal support in divorce proceedings, with discretion and security.

Divorce is a decision with personal, family and financial implications, and may involve matters such as the division of assets, the family home, parental responsibility, maintenance and other consequences arising from the end of the marriage. We assist with analysing the situation, preparing the necessary documents, negotiating agreements and supporting the process, whether by agreement or through the courts. Wherever possible, we seek balanced and legally secure solutions, without prejudice to the defence of the client's rights where no agreement can be reached between the parties.

Frequently asked questions

We clarify some of the most common questions about divorce, agreements, division of assets and the family effects of the end of a marriage.

What is the difference between divorce by mutual consent and divorce without agreement?
Divorce by mutual consent takes place when both spouses agree to the divorce and to its main effects. Divorce without agreement is necessary where there is no consensus, and the matter is heard by the court.
The documents depend on the type of divorce and the specific circumstances, but may include a marriage certificate, identification documents, a list of assets, agreements concerning children, maintenance and the family home.
Not necessarily. Divorce ends the marriage, but the division of assets may require separate proceedings, especially where there are properties, bank accounts, credit facilities, debts or disagreement between the parties.
Yes. Some agreements may be changed where there is a significant change in circumstances, particularly in relation to parental responsibilities, maintenance payments or the use of the family home.
